Advocacy Group says Under new Electoral Act, presidential/Guber candidates can't substitute running mates

The Center for Reforms and Public Advocacy (CRPA) has indicated that under the new Electoral Act 2022, running mates nominated by Presidential, Governorship candidates of various political parties are not subject to withdrawal, or substitution.

Both presidential candidates of the ruling All Progressives Congress (APC) Bola Ahmed Tinubu and Labour Party (LP) Peter Obi, submitted placeholders with the hope to substitute their running mates late.

However, a statement released Saturday in Abuja by the Executive Director of the center, Ifeanyi Okechukwu, said the Constitution and the Electoral Act 2022 make clear provisions on the yardstick for withdrawal and substitution of candidates, adding that provision, as contained in Sections 28 and 84 of the amended Electoral Act 2022, relates to only the candidate – presidential and gubernatorial – and not their running mates.

According to the statement, the substitution of candidates by political parties becomes possible in cases of withdrawal or death of candidates and these are president, gubernatorial, Senate, House of Representatives, and State Assemblies who were nominated by political parties through valid primaries in accordance with Section 29 and 84.

“Section 33 of the Electoral Act says “A political party shall not be allowed to change or substitute its candidate whose name has been submitted under section 29 of this Act, except in the case of death or withdrawal by the candidate: ‘Provided that in the case of such withdrawal or death of a candidate, the political party affected shall, within 14 days of the occurrence of the event, hold a fresh primary election to produce and submit a fresh candidate to the Commission for the election concerned’; and to conform with section 33, section 29 must be adhered to, to ascertain categories of candidates captured.

“Section 29 in subsection (1) says ‘every political party shall, not later than 180 days before the date appointed for a general election under this Act, submit to the Commission, in the prescribed Forms, the list of the candidates the party proposes to sponsor at the elections, who must have emerged from valid primaries conducted by the political party.’

“So, it is no more business as usual, the current electoral law is very stringent in many areas especially methods of political parties’ primaries, who are delegates, how withdrawal is done, how the substitution is done, and transmission of results, among others.

“The current and subsisting electoral law does not capture a scene that makes the possible substitution of associate candidates or running mates either by the account of voluntary withdrawal or death. Subsequently, any substitution of running mates nominated by presidential and gubernatorial candidates comes flat in the face of the law.

“While this might not have been a deliberate oversight, it must be accepted that the law is sacrosanct and nothing can be added or removed from it unless through amendment of sections 31 and 33 to make provision for that in the future.

“Until then, in accordance with section 31 which says “A candidate may withdraw his or her candidature by notice in writing signed by him and delivered personally by the candidate to the political party that nominated him for the election and the political party shall convey such withdrawal to the Commission not later than 90 days to the election” and section 33, only candidates who were nominated through valid primaries by political parties and whose names were submitted in accordance with section 29 can withdraw and be substituted under the law, not running mates that were not nominated through any primaries but by presidential and gubernatorial candidates.”

While commending the electoral umpire for the latest the activity by the commission in ensuring that the 2023 elections meet with the requirements of the law as established by the Constitution of the Federal Republic of Nigeria and the Electoral Act 2022, as amended, the group, however, expressed “concern about the likelihood of infractions that are already being cooked by some political parties as it relates to the issue of replacement of their associate candidates or running mates in the presidential election.

“Many lawyers, legislative experts, and even INEC have made it clear that what we are having are presidential running mates, which the Constitution and Electoral Act refer to as “associate candidate” and “running mate” and not placeholders.

The statement urged cautioned the INEC on “the catch-word of placeholders as being bandied by some political parties is not known to the law and that the law does not give a room for substitution of running mates in the 2023 election guidelines.

“We also wish to impress upon political parties that they must familiarize themselves with the relevant aspects of the new electoral law and avoid actions that are capable of causing infractions.”

Following his observations that ‘the momentum was strong’ Matt Gaetz whom 47th POTUS elect, Donald Trump nominated for Attorney General has withdrawn.

Biztellers reports that this follows his meeting with Senate and the feedback, which included two women, represented by their attorneys, who accused him of having paid for sex.

Consequently, Gaetz placed on record his full commitment to seeing “that Donald J. Trump is the most successful President in history.”

His withdrawal according his statement on micro-blogging site, X, was based on his conviction that “There is no time to waste on a needlessly protracted Washington scuffle”.

In is view, “Trump’s DOJ must be in place and ready on Day 1”.

Gaetz wrote, “I had excellent meetings with Senators yesterday. I appreciate their thoughtful feedback – and the incredible support of so many. While the momentum was strong, it is clear that my confirmation was unfairly becoming a distraction to the critical work of the Trump/Vance Transition. There is no time to waste on a needlessly protracted Washington scuffle, thus I’ll be withdrawing my name from consideration to serve as Attorney General. Trump’s DOJ must be in place and ready on Day 1.

“I remain fully committed to see that Donald J. Trump is the most successful President in history. I will forever be honored that President Trump nominated me to lead the Department of Justice and I’m certain he will Save America.”

His backers have promptly encouraged to take his seat in the House of Representatives, having been elected to the house under the flag of the Republicans to represent Florida.

Adeleke Represents SW On Ad Hoc Committee on Nat’l Electrification Plan

The Executive Governors from Nigeria’s South West have unanimously nominated Senator Ademola Adeleke as the chairman of the zone on the National Economic Council (NEC).

Adeleke is the Executive Governor of Osun State, southwest, Nigeria.

This, according to the Spokesperson to Governor Adeleke, Olawale Rasheed, transpired on Thursday, at a meeting of the NEC.

He noted that the meeting reviewed the state of Nigeria’s electricity sector and resolved to engage subnational structures to address current challenges in the sector.

“The meeting particularly sought to build on the devolution of the electricity sector and its movement into the concurrent legislative list which empowers state governments to regulate the sector in their respective areas,” he stated.

Consequently, the NEC, therefore set up an ad hoc committee to review actions in the sector by state governments and explore ways to ramp up activities through coordination, Rasheed highlighted.

ACF Pledges Support For Northern Presidential Candidates Ahead Of 2027 Elections

The Arewa Consultative Forum (ACF) has announced its decision to back Northern candidates in the 2027 general elections, citing the urgent need to address the worsening socio-economic and security challenges facing the region.

In a communique issued after its National Executive Council meeting in Kaduna on Wednesday, the forum expressed deep concern over the economic state of Northern Nigeria under President Bola Ahmed Tinubu’s administration, attributing the region’s struggles to flawed governance and poor policy decisions.

The ACF criticized the Federal Government’s economic policies, describing them as detrimental to the livelihoods of Northern citizens.

According to the communique, signed by the forum’s National Publicity Secretary, Professor Tukur Muhammad-Baba, the policies have compounded the already dire economic conditions in the region.

The statement reads, “Arewa people remain at a great disadvantage, being already worse off economically compared to other parts of Nigeria. While economic reforms are indeed desirable, they should not impoverish the same people they are meant to serve. Policies must have a human face.”

The forum noted that the North faces chronic food insecurity, limited educational and vocational opportunities for youth, and a heavy reliance on small-scale economic activities.

“Livelihoods are currently dependent on micro activities. The region faces acute and chronic food insecurity; its youths lack education and skills training. Daunting as these may be, they can be reversed. The time to think big is now,” the communique emphasized.

The ACF also addressed the pervasive insecurity in the North, warning that the situation has begun to erode public confidence in the government.

“Security is an irreducible minimum of human existence. In this regard, insecurity in its various manifestations remains the most worrisome challenge of Arewa people, that has even started to corrosively undermine the authority of government,” the forum stated.

It condemned the government’s response to the crisis, arguing that the Federal Government has failed to meet its primary duty of safeguarding lives and property.

“That those whose responsibility it is to provide security will be saying they are doing their best is unacceptable,” the communique said. “The minimum duty of government is to safeguard life and property, and doing anything less is a failure.”

The ACF faulted what it described as the “flawed leadership selection process” under the Tinubu administration, claiming it has elevated individuals without the requisite competence or experience to key positions.

It urged the Federal Government to “review, reassess, reevaluate, and re-order the direction of its economic policies with a view to giving it the needed human face.”

Looking ahead to the next general elections, the ACF pledged its support for Northern politicians who demonstrate a clear commitment to addressing the region’s challenges and fostering national development.

“Notwithstanding the parlous state of Arewa’s glaring economic conditions, the policies of the current Federal Government have continued to make matters much worse,” the communique stated.
