‘Loophole’ In Electoral Act Made Lawan Yobe North Candidate – Sowore
Omoyele Sowore, the presidential candidate for the African Action Congress, has expressed his concerns about the Electoral Act 2022, claiming that it has loopholes that enable certain candidates to be unfairly imposed on the Independent National Electoral Commission for the 2023 elections.
In a recent tweet, Sowore pointed out a specific example, alleging that the court declared Senate President Ahmad Lawan as the candidate for the Yobe North Senatorial District in an election where he never took part in the primary.
According to BIZTELLERS, the Supreme Court upheld its decision on Monday, affirming Senate President Ahmad Lawan as the All Progressives Congress’ senatorial candidate for Yobe North.
In a majority judgment delivered by the Supreme Court, an appeal filed by the All Progressives Congress (APC) against Bashir Machina’s candidacy was allowed.
The court declared Senate President Ahmad Lawan as the winner of the Yobe North senatorial candidacy, effectively overturning the result of the May 29th poll, in which Machina was declared the winner.
Reacting, Sowore said, “I had a chance to tell Nigerian lawmakers the lacuna in the Electoral Act that got the Senate President, Lawan declared a candidate in an election where he did not contest the primary.”
In a video that accompanied his tweet, Sowore, speaking at a National Assembly public hearing on the Electoral Act 2022, said: “I also seriously think that the Electoral Act has some lacuna that is being exploited by the judiciary.
“We are all aware that even though the portal for electoral process has been closed, courts are still giving conflicting judgements regarding candidates in this election, including candidates that did not even participate in the primary that have been imposed on INEC as we speak. One of them is your (Senate) President here.”
According to a report, the All Progressives Congress (APC) secured victory for Senate President Ahmad Lawan by taking Bashir Machina to the Supreme Court and maintaining that Lawan, who did not participate in the primary, was the party’s “authentic candidate.”
After the Supreme Court’s decision on Monday, Lawan spoke to journalists and praised the judgment, stating that it demonstrated that “democracy is at work.”
During the All Progressives Congress’ primary on May 8, 2022, Bashir Machina emerged as the unopposed winner of the election, while Senate President Ahmad Lawan participated but lost the party’s presidential nomination to Asiwaju Bola Tinubu.
Prior to the Supreme Court’s decision, Machina had raised concerns about Lawan and other forces attempting to take the senatorial ticket from him.
Amid the controversy, the All Progressives Congress submitted Ahmad Lawan’s name to the Independent National Electoral Commission (INEC) as its candidate.
This left the electoral body in a state of confusion, with no option but to leave the senatorial district candidacy unassigned when it released the complete list of candidates across the country.
In response, Bashir Machina took both his party and the Independent National Electoral Commission to court in a lawsuit, seeking a declaration that he was the legitimate senatorial candidate.
In September 2022, a Federal High Court in Damaturu, the capital of Yobe, declared Machina as the winner and ordered both the All Progressives Congress and INEC to recognize him as the candidate.
Furthermore, an Appeal Court in Abuja upheld Machina as the legitimate candidate of the All Progressives Congress for the Yobe North senatorial district.
After losing at both lower courts, the ruling party, the All Progressives Congress, took the case to the Supreme Court. In their argument, the party claimed that the primary election held on May 28 of the previous year, which resulted in Machina’s victory, violated the Electoral Act 2022.
The party’s counsel, Sepiribo Peters, argued that the individual who conducted the primary, Danjuma Manga, was not nominated by the National Working Committee of the party.
Peters told the court that the APC cancelled the primary due to irregularities that were observed during the election.
Peters argued that the subsequent primary held on June 9 was conducted by the National Working Committee of the APC and resulted in Lawan being recognized as the party’s legitimate candidate.
However, the lawyer for Machina, Sarafa Yusuf, asked the Supreme Court to dismiss the appeal, claiming it lacked merit, as the Senate President did not contest the suits at both the trial and lower courts.

DSS Releases Ex-Ogun PDP Governorship Candidate, Ladi Adebutu
Ladi Adebutu, the former governorship candidate of the Peoples Democratic Party (PDP) in Ogun State, has been released from detention by the Department of State Services (DSS).
He regained his freedom early Tuesday morning after being invited for questioning in connection with alleged disturbances during the local government elections held last Saturday.

His release was confirmed by his media aide, Afolabi Orekoya, in a phone interview with Channels Television.
Adebutu’s arrest on Monday was earlier confirmed by the PDP’s Ogun State Publicity Secretary, Kayode Adebayo, who disclosed that the politician was held at the DSS office in Abeokuta.
In a statement, Adebayo said:
“This is to inform the members of our great party, the Peoples Democratic Party, that the leader of the party has truly been detained by the DSS for charges yet unknown.”
The statement called for calm among party members and supporters, adding that Adebutu remained committed to upholding democratic principles.
“However, our principal has called for calm and directed that all members of the party, supporters, and well-wishers should be rest assured that this time shall pass. It is one of the prices for our democracy,” the statement read.
Attempts to secure Adebutu’s bail on Monday evening were unsuccessful, according to Adebayo, but legal representatives took charge of the matter the following morning.
“Several efforts have been made to secure his bail as of 10 p.m. on Monday, 18th November, 2024, either on personal recognition or by a surety, but none has yielded any result so far. His lawyers have been informed, and they will take it up by tomorrow (Tuesday) morning,” he stated.
The PDP urged its members and the public to remain peaceful as the situation unfolded, saying, “By this release, we want our people and the general public to be duly informed about his whereabouts and to maintain calm and peace until this matter is resolved.”
Adebutu, who contested in the 2023 Ogun State governorship election, has yet to issue a personal statement following his release.

Gov Okpebholo To Probe Mass Demolition of Homes During Obaseki’s Tenure
Edo State Governor, Monday Okpebholo, has pledged to set up a Commission of Inquiry to investigate the controversial acquisition of community lands and demolitions carried out by the previous administration of Godwin Obaseki.
This announcement was made during Governor Okpebholo’s visit on Monday to the affected communities of Oke-Oroma, Irhirhi-Obazagbon, and Ogheghe, located in Oredo and Ikpoba-Okha Local Government Areas.

The visit came two years after the demolition of over 100 houses in the area, which rendered thousands homeless and caused property losses estimated in billions of naira.
In his remarks, the governor emphasized his administration’s commitment to justice and accountability.
“I remember that during my campaign here, I promised to come back, and now I am here. We hate injustice in this administration. That is why we are here and happy to meet all of you. We will listen to your voices,” he said.
Okpebholo assured the residents that the inquiry would thoroughly examine the rationale behind the demolition and subsequent acquisition of the lands by the previous government.
The findings will guide actions to return the lands to their rightful owners, if deemed appropriate.
He added, “In the next few days, I will invite you to the Government House and back it up with actions. A few days from now, we will set up a Commission of Inquiry to look into this land issue so that we can return your lands to you after the findings.
“If Certificates of Occupancy (C of O) have been issued on the lands and the reports confirm this, I will revoke them and return the lands to the people.”
The governor also promised to prioritize security in the affected areas, stating, “Our responsibility as a government is to provide security.
I will speak with the appropriate authorities, and security personnel will come in here to restore peace.”
The controversial demolitions occurred in October 2022, under the administration of Godwin Obaseki.
At the time, the state government claimed it had legally acquired the 1,229 hectares of land in 2017 for a new urban project known as “Coral City.”
According to Chris Nehikhare, the then-Commissioner for Communication and Orientation, 106 structures were marked for demolition, with 24 slated to be repurposed as government offices.
However, affected residents disputed the state’s claims, insisting they had legally acquired their plots.
The demolitions led to widespread criticism, with many describing the government’s actions as unjust and heavy-handed.
The Coral City project, a planned urban development estimated to cost N20 billion for its first phase, was aimed at transforming the area with new infrastructure.
During an engagement in 2023, developers expressed optimism about completing the first phase within six to nine months, citing support from financial partners.

Osun 2026: Adeleke’s Camp Fires Back At Ganduje
The National Chairman of the All Progressive Congress (APC), Dr Umar Ganduje suffers from verbal diarrhea and swollen ego with an agenda to destabilise the South West zone and create a crisis for President Bola Ahmed Tinubu at the home front.
This is the salve fired from the camp of Osun State Governor, Senator Ademola Adeleke, as parties gear up for hostilities for the renewal or not of his mandate in 2026.
In a statement in Osogbo on Tuesday signed by Spokesperson to Governor Adeleke, Olawale Rasheed, they alleged that “Dr Ganduje is clearly unhappy with the peace and united front behind Mr President from the South West zone and has now launched vicious attacks to ignite regional political battles to weaken the President ahead of 2027.”
The statement in reaction to the vow by Dr Umar Ganduje to hijack Osun in 2026.
Rasheed said the anti-democratic utterances of the APC leader contrasted sharply with the democratic credentials of President Tinibu. He wondered why the APC leader would be found speaking like an amateur dictator without respect for history.
As a well-read politician, one would have expected Dr Ganduje to know that electoral contests depend mostly on local indexes and factors and that what played out in Edo and Ondo States were surely different from political facts on ground in Osun state.
Local permutations, grievances and interests dictate how people vote rather than superimposed force, the Spokesperson noted, citing the failure of the APC leader to win the Kano State governorship race for his party.
In Kano, the local peculiarities enforced the subsisting victory of the Kwankwasiyya group which beat the Ganduje caucus, despite their being in office for eight years.
He asked, “If Dr Ganduje failed in his own state because internal forces rejected his brand of politics, why is he thinking Osun factors which enthroned Gov Adeleke would not resist any attempt to disrespect the will of Osun people in 2026?”
According to the Spokesperson, Osun State is the cradle of Yoruba people where political freedom is cherished and where resistance to electoral fraud is a strong tradition, describing Dr Ganduje as “a threat to democracy and an insider enemy of President Tinubu.
“If Dr Ganduje truly loves Mr President, why is he pushing to destabilize the president’s home zone through open threats to violate electoral law and deny the electorate their rights to vote and be voted for? By threatening to hijack opposition states, the APC leader is undermining the general consensus among Yoruba people which accept Mr President as their own irrespective of political differences.
“If, however, the statement of the APC leader is borne out of ignorance, he is invited to study Osun politics to get better informed of the dynamics of this state’s politics and to appreciate that what works in Edo and Ondo cannot play out here for several reasons.
“In Osun State, the ruling party, the PDP is daily receiving thousands of decampees from opposition parties. The PDP in Osun is already a strong mass movement which cannot be overrun by a party chairman who failed to deliver his own state and who does not have the mandate of Mr President to ignite conflict in the South West zone.
“The PDP in Osun State is too deeply planted to be threatened or suppressed by any electoral robber and Governor Adeleke remains an extraordinarily popular leader whose mandate now or in 2026 cannot be hijacked by anti- democratic forces”, the Spokesperson noted.
